Use of the Viridian Tower Electronics web services is subject to our Acceptable Use Policy. By purchasing one of our services, you are signifying your agreement to follow the terms of this policy. If you do not agree to this policy, then you may not purchase Viridian Tower Electronics web services.

§0. Preamble

Viridian Tower Electronics believes strongly in freedom of speech, but we also believe in protecting the integrity and security of the internet. We do not generally exercise editorial controls over the websites, forums, and other related services which we host, however those that abuse the freedom of press and speech to harass others, harm minors, or spam the internet, will be subject to administrative action at the sole discretion of Viridian Tower Electronics.

Please note that you as the Viridian Tower Electronics client are solely responsible for your account. If you grant third parties access to your system whom then use the system for purposes considered in Viridian Tower Electronics' sole discretion to be in contravention of this policy, you are the individual responsible for this breach of policy.

§1. Unacceptable Uses

There are basically two types of uses of our services which we consider unacceptable: those that are illegal by Canadian law under which our services fall in jurisdiction, and those which are damaging or abusive of our network and/or the internet as a whole.

The following constitute illegal uses and are therefore not permitted:

  • §1.1. Harm to minors: Any content deemed to be harmful to minors is strictly prohibited.
  •    §1.1a. Child pornography explicitly disallowed: Sexually-explicit imagery of minors, as defined by the Canadian Criminal Code, is expressly prohibited. Viridian Tower Electronics will fully cooperate with law enforcement in this regards, relinquishing all account information and data to law enforcement where child pornography has been found to be hosted
  • §1.2. Harassment/Slander/Libel: While there is a large amount of questionable area in the defining of behaviour and opinions as harassment, slander, or libel, any content which is determined at Viridian Tower Electronics' sole discretion to be criminally harassment, libel, or slander, is strictly prohibited.
  • §1.3. Forgery/Impersonation: Modifying network headers or otherwise creating documents to mislead someone into believing you are someone or some entity you are not is prohibited. Use of anonymiser proxies and similar services does not constitute forgery (however if they modify HTTP or email headers they still may break this policy, it is your responsibility to be aware of how a proxy works before using it.)

The following constitute abusive or damaging uses of our network and/or the internet as a whole and are therefore not permitted:

  • §1.4. Spam: See Section 2 below. Use of our system for spam purposes is strictly prohibited and will result in actions taken against your account up to and including termination.
  • §1.5. Violation of Account-Specific Provisions: See Section 3 below. In addition Viridian Tower Electronics may, at its sole discretion, apply additional restrictions to an account which has been abusive in the past. In this case, contravention of these restrictions will result in termination of account and possibly penalty fees.
  • §1.6. Unauthorised Access: Usage of any Viridian Tower Electronics service to gain unauthorised access to any other account, service, system. or entity, or any attempt thereof, is strictly prohibited.
  • §1.7. Distribution of Viruses, Malware, Spyware: Distribution of software deemed in Viridian Tower Electronics' sole discretion to be harmful, including but not limited to viruses, malware, or spyware, is strictly prohibited.
  • §1.8. Distribution of Copyrighted Works: The unauthorised distribution of copyrighted works is expressly prohibited.

§2. Spam-Specific Provisions

Spam is unsolicited email or other messages sent from a server to advertise a product or perpetuate scams. Both of these uses are against our Acceptable Use Policy. Some specifics:

  • §2.1. Unsolicited Commercial Email: The most common type of spam, unsolicited commercial advertisements are expressly prohibited. Any account making use of mailing lists should clearly identify an unsubscribe link which is fully functional. You should always identify your relation to a recipient in an unsolicited commercial email. All emails must contain the x-abuse headers and all accounts sending unsolicited commercial emails must have a SPF record in their DNS records.
  • §2.2. Network Flooding: Sending excessive amounts of email during a given time constitutes a form of denial-of-service attack on a system and is strictly prohibited.

3. Account Specific Provisions

Due to the natre of some accounts, they have special restrictions on content. Generally speaking, accounts which are on shared servers, such as the web hosting, virtual private server hosting, and forum hosting services, are more restricted than those that are not. This is to protect the other users of the server from potential downtime or disruptions caused by a single user.

The following restrictions apply to shared web-hosting accounts:

  • §3.1. Processor Overuse: No single shared web-hosting account may account for more than 1% of processor usage at any given time and may be subject to overage charges if they are responsible for more processor usage.
  • §3.2. Memory Overuse: No single shared web-hosting account may account for more than 2.5% of memory usage at any given time and may be subject to overage charges if they are responsible for additional memory usage.
  • §3.3. No Game Servers on Shared Web-Hosting: A shared web-hosting account may not run game servers out of the shared web-hosting account (although they may purchase these services separately).
  • §3.4. No Internet-Relay Chat (IRC) Servers on Shared Web-Hosting: A shared web-hosting account may not run IRC servers out of the shared web-hosting account (although they may purchase these services separately).
  • §3.5. Pornographic Content Prohibited: No shared web-hosting account may host pornographic content. This content often results in overages and resource starvation of other shared web-hosting users. If you wish to host pornographic content, please purchase a dedicated web-hosting service.

4. Remedies

In event of contravention of this policy, Viridian Tower Electronics may remedy the matter in one of more of the following ways:

  • §4.1. Penalty Fees: Typically levied for overages or accidental and unintentional abuses of the system. (Or other abuses which, in Viridian Tower Electronics' sole discretion, are considered inconsequential, or small in nature and/or scope.)
  • §4.2. Suspension of Service: This results in the non-function of the affected service without prejudice to purchasing additional services.
  • §4.3. Suspension of Account: This results in the non-function of all services of a customer without prejudice to purchasing additional services.
  • §4.4. Freezing of Account: This results in the non-function of all services of a customer, and in addition they will not be able to purchase additional services.
  • §4.5. Termination of Account: The account is closed in our system and all related services are discontinued.
